Learning Theories Essay Lev Vygotsky, born in the U. S. S. R. in 1896, is responsible for the social development theory of learning. He proposed that social interaction profoundly influences cognitive development. Vygotsky’s key point is his belief that biological and cultural development do not occur in isolation. Vygotsky approached development differently from Piaget. Piaget believed that cognitive development consists of four main periods of cognitive growth: sensory motor, preoperational, concrete operations, and formal operations. Piaget’s theory suggests that development has an endpoint in goal. Vygotsky, in contrast, believed that development is a process that should be analyzed, instead of a product to be obtained. Marcy P. Driscoll stated (as cited in Riddle, 1999) that â€Å"Vygotsky believes the development process that begins at birth and continues until death is too complex to be defined by stages†. The major theme of Vygotsky’s theoretical framework is that social interaction plays a fundamental role in the development of cognition. Vygoysky states: â€Å"Every function in the child’s cultural development appears twice: first, on the social level, and later, on the individual level; first between people (interpsychological) and then inside the child (intrapsychological) (Funderstanding, 2001). This applies equally to voluntary attention, to logical memory, and to formation of concepts. All the higher functions originate as actual relationships between individuals. A second aspect of Vygotsky’s theory is the idea that the potential for cognitive development is limited to a certain time span that he calls the â€Å"zone of proximal development† (ZPD). Vygotsky believed that this life long process of development was dependent on social interaction and that social learning actually leads to cognitive development (Kearsley, 1998). Vygotsky describes it as â€Å"the distance between the actual development level as determined by independent problem solving and the level of potential development as determined through Learning Theories 3 problem solving under adult guidance or in collaboration with more capable peers† (Funderstanding, 2001). In other words, a student can perform a task under adult guidance or with peer collaboration that could not be achieved alone. The Zone of Proximal Development bridges the gap between what is known and what can be known. Vygotsky claimed that learning occurred in this zone. Therefore, Vygotsky focused on the connections between people and the cultural context in which they act and interact in shared experiences. According to Vygotsky, humans use tools that develop from a culture, such as speech and writing, to mediate their social environments. Initially, Children develop these tools to serve solely as social functions, ways to communicate needs. Vygotsky believed that the internalization of these tools led to higher thinking skills (Riddle, 1999). When Piaget observed young children participating in egocentric speech in their preoperational stage, he believed it was a phase that disappeared once the child reached the stage of concrete operations. Driscoll states (as cited in Riddle, 1999) â€Å"in contrast, Vygotsky viewed this egocentric speech as a transition from social speech to internalized thought†. Thus, Vygotsky believed that thought and language could not exist without each other. Vygotsky’s theory was an attempt to explain consciousness as the end product of socialization. For example, in the learning of language, our first vocal noises with friends or adults are for the purpose of communication, but once mastered they become internalized and allow â€Å"inner speech†. Traditionally, schools have not promoted environments in which the students play an active role in their education and in the education of their friends. Vygotsky’s theory, however, requires the teacher and students to play untraditional roles as they collaborate with each other. Instead of a teacher dictating the lessons to students and later evaluate them, a teacher should collaborate with her students in order to create meaningful ways that students can make their own evaluation. Learning then becomes a reciprocal experience for the students and the teacher. Learning Theories 4. The physical classroom, based on Vygotsky’s theory, would provide clustered desks or tables and work space for peer instruction, collaboration, and small group instruction. Like the environment, the instructional design of material would be structured to promote and encourage student interaction and collaboration. Thus, the classroom becomes a community of learning. Because Vygotsky asserts that cognitive change occurs within the Zone of Proximal development, instruction would be designed to reach a developmental level that is just above the student’s current developmental level. Vygotsky proclaims, â€Å"learning which is oriented toward developmental levels that have already been reached is ineffective from the view point of the child’s overall development. It does not aim for a new stage of the developmental process, but rather lags behind this process† (Social Development, 1996). Appropriation is necessary for cognitive development within the zone of proximal development. Individuals participating in peer collaboration or guided teacher instruction must share the same focus in order to access the zone. Samuel J. Hausfather states (as cited in Riddle, 1999), â€Å"joint attention and shared problem solving is needed to create a process of cognitive, social, and emotional interchange†. Furthermore, it is essential that the partners be on different developmental levels. In addition, the partner that is on the higher level needs to be aware of his partner’s lower level. If this does not occur, or if one partner continually dominates, the interaction is less successful. Scaffolding and reciprocal teaching are effective strategies to access the zone. Scaffolding requires the teacher to provide students the opportunity to extend the current skills and knowledge. Hausfather reports (as cited in Riddle, 1999) â€Å"the teacher must engage students’ interests, simplify tasks so they are manageable, and motivate students to pursue the instructional goal. In addition, the teacher must look for discrepancies between students’ efforts and the solution, control for frustration and risk, and model an idealized version of the act†. Learning Theories 5 Reciprocal teaching allows for the creation of a dialogue between students and teachers. This two-way communication becomes an instructional strategy by encouraging students to go beyond answering and discussing questions. A study (as cited in Riddle, 1999) demonstrated the Vygotskian approach with reciprocal teaching methods in their successful program to teach reading strategies. The teacher and students alternated turns leading small group discussions on reading. After modeling four reading strategies, students began to assume the teaching role. Results of this study showed significant gains over other instructional strategies. Cognitively Guided Instruction is another strategy to implement Vygotsky’s theory. This strategy involves the teacher and students exploring math problems and then sharing their different problem solving strategies in an open dialogue (Riddle, 1999). Vygotsky’s social development theory challenges traditional teaching methods. Historically, schools have been organized around recitation teaching. According to Hausfather, (as cited in Riddle, 1999) â€Å"the teacher disseminates knowledge to be memorized by the students, who in turn, recite the information back to the teacher†. However, the studies described above offer empirical evidence that learning, based on the social development theory, facilitates cognitive development over other instructional strategies (Riddle, 1999). School structure does not reflect the rapid changes that society is experiencing. Opportunities for social interaction have greatly increased with the introduction and integration of computer technology. Therefore, the social context for learning is transforming as well. Learning relationships can now be formed from distances through cyberspace, whereas collaboration and peer instruction was once only possible in shared physical space (Bacalarski, 1994). Computer technology is a cultural tool that students can use to mediate and internalize their learning. According to Kathryn Crawford (as cited in Riddle, 1999) â€Å"recent research suggest changing the Learning Theories 6 learning contexts with technology is a powerful learning activity†. If schools continue to resist structural change, students will not be as prepared as they should be for the world. Lev Vygotsky lived during the Russian Revolution, a time of great change in his culture. His theory was that biological and cognitive development does not happen apart from each other. These two developments sustain and grow from each other. This is when learning takes place. Because of this theory, his environment of change was a great influence in his own cognitive processes. Impact of Student Socio-Economic Background on Performance â€Å"THE IMPACT OF STUDENT’S SOCIO-ECONOMIC BACKGROUND ON ACADEMIC PERFORMANCE† A CASE STUDY OF NORTH-EAST STUDENTS IN LOVELY PROFESSIONAL UNIVERSITY (PUNJAB) JALESH GURUNG CHAPTER I INTRODUCTION ORIENTATION OF THE PROBLEM Education is a basic tool used by society for transmission of its societal values and culture. so, every parents are the most immediate relation of a child for their development and growth. Their financial status and education do have an important influence on the personality of child. For instance educated parents can better understand the educational needs and their children’s aptitude. They can help their children in their early education which affects their proficiency in their relative area of knowledge, confidence, idea, etc. While, Belonging to strong financial background, parents can provide latest technologies and facilities in a best possible way to enhance educational capability of their children as well as they provide good education facilities also. Socioeconomic status is an economic and sociological combined total measure of a persons work experience and of an individuals or family’s economic and social position relative to others, based on income and education, and occupation (Marmot, Michael, 2004) indicates When analyzing a family’s social economic status, the household income, earners’ education and occupation are examined, as well as combined income, versus with an individual, when their own attributes are assessed. Many factors and reasons have been given as being responsible for the continuous falling in the academic standard of our present educational system. These includes; attitudes of teachers to work, lack of seriousness on the part of the students, effect of the dwindled economy and to some extent the increasing degenerating moral system. According to Lareau, Annette ( 2003) observes that Socioeconomic status is typically broken into three categories, high, middle, and low to describe the three areas a family or an individual may fall into when placing a family or individual into one of these categories any or all of the three variables income, education, and occupation can be assessed. Additionally, low income and little education have shown to be strong predictors of a range of physical and mental health problems due to environmental conditions may be the entire cause of that person’s social predicament to begin with. Most economically disadvantaged children have effectively mastered the usual developmental childhood tasks of motor and language skills, and have learned the values of social practices of their homes and neighborhoods (Harry Klingner, 2007); but they may not have learned particular forms of language or the ways in which schools use specific forms of language to the extent that their middle inco me peers have. Therefore, it can be assumed that students’ failure to achieve academically may be explained by other factors also. The amount of money that a family has or the color of a child’s skin should not influence how well that child learns (Rothstein, 2004) Literature review These chapter focus on the relevant and related literature of various researches in an attempt to relate their work to this study. Sub topic related to the literature review are as follows: The concept of social and economic problems Relationship between parents income to the students. The students academic performance as well as social adjustment (i)The concept of social and economic problems While sociology use some broad theoretical sense to explain the concept and meaning of society and its activities. They divide the macro-level society into two broad perspectives, namely functionalism and conflict theory, and then the feminist theory, which combines both micro and micro-levels of analysis, and also the interactions theory, a micro –level analysis which is by far the most influential of the social psychological theories in sociology. (Coleman and Cressey, 1999).The idea make up of the society in such that individual and group of individual is co-exist in the society and make them as a harmony and pace without any threat to the society. Moreover the concept of social and economic problems is that misconstrued by many people. (ii)Relationship between parents income to the students. APA ( 2001) describe the relationship of family socioeconomic status to childrens readiness for school, Across all socioeconomic groups; parents face major challenges when it comes to providing optimal care and education for their children. For families in poverty these challenges can be formidable. Sometimes, when basic necessities are lacking, parents must place top priority on housing, food, clothing, and health care. Educational toys, games, and books may appear to be luxuries, and parents may not have the time, energy, or knowledge to find innovative and less-expensive ways to foster young childrens development. Furthermore,( Ominde, S.H 1964) observes that even in families with above average income parents often lack the time and energy to invest fully in their childrens preparation for school, and they sometimes face a limited array of options for high-quality child care both before their children start school and during the early school years. Kindergarten teachers throughout the country report that children are increasingly arriving at school inadequately prepared. Families with low socioeconomic status often lack the financial, social, and educational supports that characterize families with high socioeconomic status. Poor families also may have inadequate or limited access to community resources that promote and support childrens development and school readiness. Parents may have inadequate skills for such activities as reading to and with their children, and they may lack information about childhood immunizations and nutrition. Lareau, Annette (2004) state that low maternal education and minority-language status are most consistently associated with fewer signs of emerging literacy and a greater number of difficulties in preschoolers. Having inadequate resources and limited access to available resources can negatively affect families decisions regarding their young childrens development and learning. As a result, children from families with low socioeconomic status are at greater risk of entering kindergarten unprepared than their peers from families with median or high socioeconomic status. Amutabi, M.A (2003) says that the impact of socioeconomic status on children’s readiness for school: while the segregating nature of social class, ethnicity, tradition may well reduce the variety of enriching experience through to be prerequisite for creating readiness to learn among children activates. Similarly, cast ethnic value, housing, neighborhood and access to resource that directly or indirectly affect enrichment or deprivation as well as the acquisition of specific value system (iii)The student’s academic performance as well as social adjustment Academic performance of students in the classroom is very important as this is capable of determining whether the student is doing well or not. Parents, Teachers, School Administrators attach so much importance to students’ academic performance that if the students are not performing well academically, then they see all other efforts of the students in the school programme as a total waste. These people pretend as if there are no other activities for the student in the school environment aside the academics, hence academic performance defines the totality of the child in his school life. Contrary to the opinion of this group, it is important that there are many factors that determine the level of a student’s academic achievement, chief among these factors is social adjustment. Moreover, academic performance has been seen as a term used for students based on how well they are doing in their studies and classes. This definition tends to see academic performance as the culmination of all the activities of the student in the school. Academic performance for the student is also seen as the extent to which a student has achieved his educational goals (Wikipedia, 2012-2014). 1.3 Statement of the problems According to study published in 2001 issue of Psychological Science found that children of parents with a high socioeconomic status tended to express more disengagement behaviors than their less fortunate peers. In this context, disengagement behaviors represent actions such as fidgeting with other objects and drawing pictures while being addressed. Other participants born into less favored circumstances tended to make more eye contact, nods as signs of happiness when put into an interactive social environment. The more fortuitous peers felt less inclined to gain rapport with their group because they saw no need for their assistance in the future. However, Socio-economic status can be measured in a number of different ways. The prime things that commonly it is measured by father’s education, occupation and income. All familys socioeconomic status is based on family income, parental education level, parental occupation, and social status in the community such as contacts within the community, group associations, and the communitys academic performance of the family, while families with high socioeconomic status often have more success in preparing their young children for school because they typically have access to a wide range of resources to promote and support young childrens development in day to day life. They are able to provide their young children with high- quality child care, books, and toys to encourage children in various learning activities at home but lack in poor ones. And , they have easy access to information regarding their childrens health, as well as social, emotional, and cognitive development. In addition, families with high socioeconomic status often seek out information to help them better prepare their young children for school and college. The study aimed at finding o ut the contribution of socio-economic status of the family on the academic performance of the student in private Universities in Punjab, A case study of North-East students in lovely professional university. 1.4 Objective To study the relationship between socio- economic status of families and its impact on the academic performance of the students in university. To study the impact of the level of parents’ education on the academic performance of the students in university level. To study the impact of occupations of parents on academic performance of the students in the in university. Similarly, to know about the negative impact as well as positive impact on the students performance. To study the impact of family income on academic performance of the students in the various courses in university. To study the impact of expenditure on children’s education on their academic performance in the university. To know about the student’s academic performance (TGPA/CGPA) according to their families socio-economic background. CHAPTER-II METHODS AND PROCEDURE 2.1 STUDY AREA 2.2METHODS While, according to the availability of data the method adopted for this study was descriptive and statistical in nature. The sample consists of 95 students selected from different courses in the university. Therefore, Out of 95 students 36 were males and 59 were females in age range of 20 to 30 from different schools. To have a comparative study of the boys and the girls ,the sample was drawn from both the boys and the girl’s institutions. Stratified random sampling technique was applied for selection of the students for the sample. Similarly, For a detailed technical discussion of all that will be presented in this section, see Dachs et al (2006) Figure 1 –Heretical web of determinants of academic performance of students at university (Dechs et al. 2006) 2.3 QUESTIONNAIRE A self designed questionnaire was used for collection the data. First of all, The questionnaires were designed keeping in mind the objectives of the study and the clarity required at the field level for filling the questionnaire. In this study both types of questionnaire are used i.e. closed-ended as well open ended or combination of both. 2.4 DATA COLLECTION The primary data was collected through the help of questionnaires. While its carry both types such as closed ended as well as open ended questions and they are self administered. All around 95 of questionnaires ware distributed in different block of the University. Secondary data were collected by the appropriated data sources including news paper, books, journals, and activities both published and un-published data sources. Therefore, the data were collected by the method of snow ball survey as well as self distributed. Generally I followed this methods because it was save my time and costs. Additional documents were collected by the university faculty and from friends as well. 2.5 PROCESSING OF DATA The Entire data from the field observation was processed and tabulated in the computer unit. However these processes include the writing, interpretation, analysis of data etc. The programmed for the data feeding, coding of data, scrutinizing of data, preparing of table for the report as well as preparing of statistical volume and analytical tools likewise bar diagram, percentages, pie chat etc.

Literature Comparison: The Great Gatsby and The Motorcycle Diaries What it makes us unique, is our way of being; no one is equal to other, all of us are different in every single way, and this is the most important characteristic of the human beings, but sometimes our way of being is not the right one. There exist people that spend their lives thinking in the welfare of the rest but in the other hand there exist people that spend their lives thinking only about themselves. Examples of these two types of people are shown in the books The Motorcycle Diaries by Ernesto Che Guevara and The Great Gatsby by F. Scott Fitzgerald. The great Gatsby is a book that is developed by the 1920s in the twentieth century and it is set in Long Islands North Shore, the book is narrated by Nick, a man who lived next to a mysterious and rich man called Jay Gatsby, they lived in the west coast of Long Island the less popular one. Jay Gatsby was a young rich man with a turbulent past, he was not have a position in the society that surrounded him and nobody knew how he had obtained his fortune. Some people believed that he had gained his fortune with the illegal sale of alcohol they believed that Gatsby was a bootlegger, Anyway and despite the great parties that he organized for the people of Long Island, he was a lonely man, because he only wanted to revive the past in order to be with the love of his life Daisy, who was also cousin of Nick; nevertheless, Daisy was married with the millionaire Tom Buchanan with who had a three years old daughter, Pam, they lived in the east coast of Long Island the most popular one, they wer e different from Gatsby because they were rich from birth, and they had a place in the society of those years. When Gatsby met Daisy he was a soldier of the militia and he was not rich, when he came back from the military service he discovered that Daisy was married with Tom and he decided to spend his life trying to have money in order to give to daisy what she deserved. When Gatsby was younger he had a mentor Dan Cody who helped him to make his fortune as a result Gatsby became rich but lonely, he lived in a big mansion and he gave parties whit the only reason that he hopped that some day Daisy come to one of his parties, actually one day Gatsby decided to invite to one of his parties to Nick his neighbor, when nick received the invitation he was surprised and he decided to go but he did not know that Gatsby invited him with the only reason that he knew that he was cousin of his love interest; Daisy, in the party Gatsby met Nick and they became friends but this friendship to Gatsb y had a purpose that was to join with Daisy again. Gatsby could achieve his purpose and he could join Daisy through Nick, and they started an affair and Gatsby could have what he wanted that was recover Daisy but when Tom discovered the affair of his wife with Gatsby, he asked them and Daisy recognized the affair but and she escaped with Gatsby in the car but in the road she hit Myrtle, the mistress of his husband, Tom, with the car and she killed her, and Gatsby in certainly way decided to do not tell anyone that Daisy killed Myrtle because he loved her but Daisy finally decided to stay with his husband because she was a woman of society and also she was very interesting in money and stability. Gatsby was not a bad man but he spent his life thinking in how to obtain what he wanted, he also did not think in the daughter of Daisy or what will happen with her if her mother escaped with him, he did not care about her and her husband he only was thinking in that he wanted to be with Dai sy again, in fact, he spent a lot of money in those extravagant parties in which he did not participate he only watched through the windows of the house looking to the people that were in his there with the hope that Daisy arrived to at least one of his outrageous parties, he was thinking all the time in how to obtain what he wanted in order to be happy no matter how. On the other hand the book The Motorcycle Diaries by Ernesto Che Guevara is a book of notes that Ernesto wrote during his trip with his friend Alberto Granada; Ernesto was a young medical student of medicine tired of school and excited to see the world and Alberto was working in a leprosy hospital in Argentinas Cà ³rdoba Province, and because of this he and his friend decided to do a trek through South America in an old motorcycle called the mighty one (la poderosa). The trip took eight months, the travel started in Cà ³rdoba and they left Argentina to go to Chile, they arrived in this country in Osorno passing through all the country to leave it to go to Perà º they leave this country and then they went to Colombia and finally Venezuela however they could not finish the trip in the motorcycle because they had to leave it in Santiago, Chile because the mighty one did not work any more. This book shows the trip of these two young men by the perspective of Ernesto, he wrote all the adventures and things that they did, and saw during their trek through South America. Guevaras political consciousness began to stir in this trip as he and Alberto moved into the mining country, Chile. They visited Chuquicamata copper mine, the worlds largest open-pit mine and the primary source of Chiles wealth in those years. It was run by U.S. mining monopolies and viewed by many as a symbol of foreign domination, and also to Ernesto was a symbol of human exploitation. During the trip Guevara also could apply his knowledge in medicine because he helped people that needed it for example in Chile he helped an old woman that was dying, he knew that he could not save the life of this woman, but he could stop the pain for a moment. Passages like this, change the mind of Ernesto because during the trip he could see that there existed and exist needed people not only in South America but all over the world. His political and social awakening has very much to do with this face-to-face contact with poverty, exploitation, illness, and suffering, [Internet reference: www.nationalgeographic.com] Guevara was a good man that changes his mind with this trip and after it he decided to star his career as a politician and help people, he decided this because of what the saw during this trip, for them all what they were seeing was in a certain way new because in Argentina they did not see aborigines for example, one thing that capture the attention of Ernesto and Alberto was the situation when they were traveling through Perà º and an Indian with his son who spoke Spanish approached them and asked them all about the land of Perà ³n, for the natives, these two young men came from a wonderful country where people could work and have a good pay for it, a developed country. Ernesto was very impressed by the old Inca civilization, riding trucks with the Natives and animals he felt a fraternity with the native people. Ernesto was a good man always worries for the rest, it is obvious why he was studying medicine, and it was during the trip that he made with his friend Alberto Granadas Jay Gatsby and Ernesto Guevara were two young men very different in what they wanted or their purposes in life, I think that these two men were not bad men specially Ernesto who spent his life in order to defend the rights of people. I believe that there not exist so many people that think like Ernesto but in the other hand there many people that think like the Great Gatsby, because most of people spend their lives thinking in how to obtain what they want, I think this is not bad but there are people that do not think in nothing else that how to get what they want and this people sometimes sin of selfish because they do not care if they make some damage to other people in order to have what they want to be happy. One phrase that represents what Ernesto felt after his trip is one that he wrote in his diary that says: I will be on the side of the people à ¢Ã¢â€š ¬Ã‚ ¦ I will take to the barricades and the trenches, screaming as one possessed, will stain my weapons with blood, and, mad with rage, will cut the throat of any vanquished foe I encounter,[Guevara, 2004 ] Many historians believe that this trip was the most important thing in the life of Ernesto that changes his mind to after be one of the most famous guerilla leaders in history, but nevertheless he was a person that was care about the rest all the time. On the other hand Jay Gatsby was not a bad person but he was always thinking how to obtain what he wanted that it was be with Daisy, in the sixth chapter of the book Nick narrated: He wanted nothing less of Daisy than that she should go to Tom and say: I never loved you. After she had obliterated four years with that sentence they could decide upon the more practical measures to be taken. One of them was that, after she was free, they were to go back to Louisville and be married from her house just as if it were five years agoà ¢Ã¢â€š ¬Ã‚ ¦ Im going to fix everything just the way it was before, he said, nodding determinedly. Shell see.[Fitzgerald 1925:54] He was so stubborn in be with her that he did not realize that he could damage other persons, for example Myrtle; she died because Daisy and Gatsby were running away from Tom, and even Gatsby died because of this. He died because of his obsession with Daisy because of his obsession in getting what he wanted. Gatsby was killed by Myrtles husband because Tom told him that Gatsby hit Myrtle with the car, also in Gatsbys funeral there were only three people; Nick, Gatsbys father and the person that was guiding the funeral although Gatsby always gave partied to everyone none of these people came to his funeral he was alone also when he died. I think that is not bad fight for what you want but sometimes be too obsessive with something is not good because everything can go wrong. Gatsby was so obsessive with Daisy and all what he wanted that he forgot to live a real life and make real friends. Life with a Siberian Husky I really had no idea what I was getting intowhen I decided to get a Siberian Husky for a pet. Don't get me wrong: Iwouldn't trade him for anything and I love him dearly, but this animal has hisown plan - his own agenda. The last three years of my life have been anawakening to the downright mischievous nature of these dogs. I've met other Husky owners and they all have the same stories of their dogs running away and possessing the trademark Husky stamina. They also tell of the little idiosyncrasies, such as their dogs "talking" and the way Huskies know when you're speaking about them when they are in the room. All of these owners are amazed at the Houdini-like capabilities these dogs have to help them escape any enclosure. I have a few entertaining stories of my own about my Husky, Khayman. First of all, he is the dog that everyone loves and no one wants to own. I can barely get anyone to watch him for more than ten minutes. It's not that Khayman is a mean animal--he isn't--he is just clever. Part of the reason everyone likes him is because of his looks, but mostly he's got a lot of personality. His bandit mask and two different colored eyes (blue and brown) get him attention, pats on the head, dog biscuits at the gas station, and royal treatment whenever anyone finds him on his escapades (which, mind you, have been many). INTRODUCTION In Malaysia, the Income Tax Act 1967 Section 3 sets the scope of income tax provided that income accrued in or derived from Malaysia would be tax. However, S3B of the Act specifically provides that income derived by an offshore company in respect of offshore business activity is not chargeable to income tax. The law governing the tax for such offshore business activity is the Labuan Offshore Business Activity Tax Act 1990 and not the Income Tax Act 1967. The Act imposes income tax on income, while capital gains are not chargeable to income tax.Generally, income has the characteristics of repetitive, flow from a source of income and received in the ordinary course of business. It must also be examined from the recipient's perspective. On the other hand, capital receipts are non-business income and it arises independently, that are not considered as business income and treated as capital gain. For instances, realisations from long term investment or personal assets are cap ital transactions. Such gains are capital receipts.Moreover, Commonwealth laws provided that the income source is not necessarily of one which is expected to be continuously productive, but it must be one whose object is the production of a definite return, excluding anything in the nature of a mere a windfall. Windfall, gambling or profits arising from speculative activities are capital gains and would not be subject to income tax. Also, cost saving is not income and would not be taxed. The distinction between ‘capital’ and ‘income’ is crucial as capital receipts generally escaped tax.Making the distinction between ‘capital’ and ‘income’ is never an easy task, especially in relation to the compensation on termination of a business contract. Generally, compensation for payment of services is income receipts while compensation for destruction of capital structure is capital receipts. The Act does not define ‘income’ or ‘capital’; therefore one needs to research through the cases laws for guidance. CASE LAW – Van den Berghs Ltd v Clark Fact A margarine manufacturer entered into business alliance agreements with a Dutch competitor.Following a dispute over amounts due to the company, the Dutch competitor paid ? 450,000 as damages for the cancellation of the company’s future rights under the agreements, which still had a number of years left to run. The issue arise whether the compensation was an income or capital receipt. Held The House of Lords held that this payment was a capital receipt of the company. In his judgement, Lord Macmillan propounded the â€Å"whole structure† test as the test for determining the nature of such compensation.His Lordship was of the opinion that these terminated contracts were not ordinary commercial contracts made in relation to the sale of goods but were related to the whole structure of the profit-making apparatus of the manufacturer. The contracts regulated the taxpayer’s activities, defined what the parties in the contract may or may not do and further affected the whole conduct of the business. As the compensation was related to the termination of that which was fundamental to the trader’s activities, it was therefore a capital receipt. CONCLUSION The case above illustrated the difficulty in distinguishing between income and capital.With the same facts, the High Court and Federal Court could arrive at different conclusions. It is therefore concluded that the question of income or capital is a question of law for the courts to decide. As summary, table below show the different of income and capital receipts.
